The Services may include:

  • Airspace detection and monitoring
  • Aircraft and drone identification
  • Asset classification and whitelisting
  • Monitored airspace zones
  • Incursion and proximity alerts

  • Reporting and administrative tools

The Services are intended for monitoring and situational awareness only. Austin Sensing Company does not command, control, coordinate, or operate drones or aircraft.

You remain responsible for all operational, safety, security, and regulatory decisions. The Services should not be used as the sole basis for emergency, law-enforcement, aviation, or safety-critical decisions.

3. Eligibility and Accounts

You must be at least 18 years old to use the Services.

You agree to:

  • Provide accurate and current account information
  • Maintain the confidentiality of your login credentials
  • Restrict account access to authorized users
  • Notify us promptly of suspected unauthorized access
  • Accept responsibility for activity conducted through your account

We may suspend or terminate accounts containing inaccurate information or accounts used in violation of these Terms.

4. Intellectual Property

The Services, including their software, source code, databases, functionality, designs, text, graphics, trademarks, and logos, are owned by or licensed to Austin Sensing Company and are protected by applicable intellectual-property laws.

Subject to these Terms and any applicable service agreement, Austin Sensing Company grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services for your authorized internal purposes.

You may not copy, modify, distribute, sell, license, reverse engineer, or commercially exploit any part of the Services except as expressly authorized in writing by Austin Sensing Company or permitted by applicable law.

Austin Sensing Company retains all rights not expressly granted under these Terms.

5. Customer Data and Asset Information

You retain ownership of information you submit to the Services.

You grant Austin Sensing Company the limited right to host, process, transmit, and display that information as necessary to provide, maintain, secure, and improve the Services.

The platform may store drone serial numbers and aircraft ICAO identifiers to classify or whitelist known assets. You are responsible for ensuring that information you submit is accurate and that you have the necessary authority to provide it.

You may not submit information that violates applicable law or the rights of another person or organization.

6. Fees and Payment

Fees, billing terms, and subscription periods will be specified in the applicable order form, service agreement, or online purchase process.

We accept payment by ACH bank transfer, wire transfer, credit card, or another mutually agreed commercial payment method. Unless otherwise stated, all payments must be made in U.S. dollars.

You agree to provide accurate billing information and pay all applicable charges and taxes. We may correct pricing errors and refuse or cancel orders affected by those errors.

If your subscription renews automatically, you authorize us to charge your payment method for each renewal period until the subscription is canceled.

You may cancel a subscription through your account or by contacting us. Unless otherwise stated in an applicable agreement, cancellation will take effect at the end of the current paid term.

8. Third-Party Data and Services

The Services may display or process information received from third-party sensors, networks, data providers, maps, or other systems.

Austin Sensing Company does not control these third-party sources and does not guarantee that their data will always be complete, accurate, current, or available.

Third-party services may be governed by separate terms and privacy policies. Austin Sensing Company is not responsible for third-party products, services, or content.

9. Detection and Alert Limitations

Airspace detections and alerts may be delayed, incomplete, inaccurate, duplicated, or unavailable because of sensor coverage, environmental conditions, interference, equipment failure, data-source limitations, network availability, or other factors.

The absence of a detection or alert does not confirm that an aircraft, drone, or other object is not present.

Austin Sensing Company does not guarantee that the Services will detect, identify, classify, or alert on every aircraft, drone, or airspace event.

10. U.S. Government Rights

The Services are “commercial products” and “commercial services,” as those terms are defined under applicable federal acquisition regulations.

If the Services are acquired by or on behalf of a U.S. government agency, they are provided subject to these Terms and any applicable FAR or DFARS provisions governing commercial software and technical data.

11. Availability and Modifications

We may modify, update, suspend, or discontinue all or part of the Services at any time.

We do not guarantee that the Services will be continuously available or free from interruptions, delays, vulnerabilities, or errors. Maintenance, updates, equipment failures, network outages, and third-party systems may affect availability.

We may correct errors, inaccuracies, or omissions in the Services without prior notice.

12. Term and Termination

These Terms remain in effect while you use the Services.

We may suspend or terminate your access if you:

  • Violate these Terms
  • Fail to pay applicable fees
  • Create a security, legal, or operational risk
  • Use the Services in a manner that may harm Austin Sensing Company, our clients, or others

Upon termination, your right to use the Services ends immediately. Provisions that are intended to survive termination will remain in effect.

TO THE FULLEST EXTENT PERMITTED BY LAW, AUSTIN SENSING CO. DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR CAPABLE OF DETECTING OR IDENTIFYING EVERY AIRCRAFT, DRONE, OR AIRSPACE EVENT.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Before initiating arbitration, the parties agree to attempt to resolve any dispute through informal negotiations for at least 30 days after written notice of the dispute.

If the dispute cannot be resolved informally, it will be resolved through binding arbitration administered by the American Arbitration Association under its applicable rules.

Unless applicable law or the arbitration rules require otherwise, arbitration will take place in Travis County, Texas.

If a dispute proceeds in court rather than arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas.

Arbitration will be conducted only on an individual basis. To the fullest extent permitted by law, disputes may not be consolidated or brought as class, collective, or representative actions.

Claims involving intellectual-property rights, unauthorized access, theft, privacy violations, or requests for injunctive relief may be brought in a court of competent jurisdiction.

18. Electronic Communications

By using the Services, sending us emails, or completing online forms, you consent to receive electronic communications from Austin Sensing Company.

You agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement that they be provided in writing.

19. Miscellaneous

These Terms, together with the Privacy Policy and any applicable order form or service agreement, constitute the entire agreement regarding your use of the Services.

If an order form or service agreement conflicts with these Terms, the order form or service agreement will control.

Our failure to enforce a provision does not waive our right to enforce it later.

If any provision is found unenforceable, the remaining provisions will remain in effect.

You may not assign your rights or obligations without our written consent. Austin Sensing Company may assign its rights and obligations as part of a merger, acquisition, financing, reorganization, or sale of assets.
